J. Burkhardt “Burk” Beale is an attorney dedicated to the practice of DUI/DWI and criminal defense. Burk has been successfully representing his clients for a period of 33 years, and brings to the table more than just an impressive resume – he brings knowledge and experience as well as a creative mindset to provide his clients with the best possible defense.

A lifetime resident of the Commonwealth of Virginia, Burk graduated from the University of Virginia in 1977 with a Bachelor of Arts degree majoring in psychology and government. He obtained his law degree from the Washington and Lee University School of Law in 1980. Burk was the third generation of his family to graduate from W&L School of Law.

Pursuing a career in criminal defense, Burk initially gained some experience with a Richmond law firm before joining David Boone in January, 1982, where he gradually earned a reputation for zealous advocacy.

Today, he continues to concentrate in the areas of DUI or DWI law, traffic law and all types of criminal defense cases in both state and federal courts. As DUI law is a specialized field, Burk found it necessary to become a certified breath test operator and a field sobriety test instructor conducting field sobriety tests by the National Highway Traffic Safety Association (NHTSA) to know everything a police officer is taught to do so he can prepare a better legal defense for his clients.

Over the years, Burk has established himself as an authority in his areas of practice:

  • Burk has been selected to be part of an elite group of top attorneys from the state of Virginia, and is included in the Top 100 Trial Lawyers for the National Trial Lawyers.
  • Burk was selected as one of the Top 100 Criminal Defense Lawyers in Virginia, and has accepted membership into the American Society of Legal Advocates (ASLA).
  • Burk is the only Founding Member of the National College for DUI Defense (NCDD) from the Commonwealth of Virginia which celebrated its 20th year anniversary in 2014.

He is responsible for arguing four landmark cases in the field of traffic, criminal defense and DUI law that were cited as the most important case of the year in that field when the case was decided by commentators in Virginia:

  • Zimmerman v. Commonwealth, which became a precursor for drug courier profile stops in Virginia;
  • Taylor v. Commonwealth, successfully challenging the then Virginia Model Jury Instructions on evidence in DUI cases;
  • Lash v. The County of Henrico, challenging multiple convictions for the same driving behavior;
  • Basfield v. Commonwealth, challenging the statutory admissibility of a blood tests in DUI cases

Publications and Lectures.

Burk is the co-author of “Defense of Serious Traffic Cases in Virginia,” and “Defending Criminal Cases in Virginia,” that are publications by the Virginia Continuing Legal Education (CLE) where he concentrated on search and seizure law, the privilege against self-incrimination, appeals, and the scientific aspects in DUI or DWI cases. Furthermore, Burk has lectured more than 75 times on DUI defense, criminal defense and traffic matters on both a statewide and national level.

  • Burk is both a general and board member of the Virginia Association of Criminal Defense Lawyers (VACDL).

Burk decided to become a lawyer when he was in the 4th grade after studying the politics and history of the American Revolutionary War. He found himself relating to the struggles for those who wanted to guarantee the rights of all citizens against the power and tyranny of an oppressive government. He has seen far too many people plead guilty or be convicted when their case could have been won. He has dedicated his professional career to assisting those who have put their faith and confidence in him.

David E. Boone

As a young boy growing up in Northern Virginia, David E. Boone was fascinated with two television shows: Sky King and Perry Mason. One depicted a ranch owner who owned an airplane and flew to various adventures whereas the other featured a famed criminal defense attorney who relished the courtroom. Growing into adulthood, David emulated both. Today, David has logged over 3,000 hours flying his V tailed Bonanza to various locales around the country, including desolate islands in the Caribbean. And he has logged even more hours in courtrooms throughout Virginia and other states, defending people who have been accused of everything from murder to corporate fraud.

Education and Background

David graduated from George Mason University cum laude in 1970. He then attended Naval Officer Candidate School in Newport, Rhode Island and was commissioned as an Ensign. By an Act of Congress, he was declared an Officer and a gentleman in March of 1971. Assigned to a destroyer, the USS Morton (DD-948), he spent two tours of duty in Vietnam providing ground support to both the Army and Marine Corps troops in addition to “plane guarding” for aircraft carriers.

Completing his Naval career as a Lieutenant in 1973, he entered the University of Richmond Law School, with an early completion in 1975. During this period, he also attended the University of Kent in Canterbury, England, where he studied trial tactics under some of the finest Barristers in England. Finishing at the top of his law school class, he was chosen to serve as a Law Clerk to Honorable D. Dortch Warriner, a United States District Judge in Richmond.

During his two-year tenure, David was published in the University of Richmond Law Review, having co-authored Privately Filed Discrimination Actions in Federal Courts: Non-Substantive Matters Affecting Liability and Relief. Completing the clerkship in 1978, he joined the Richmond law firm of Francis, Hubard, Tice and Warren. During his time there, David handled many of the criminal cases the firm accepted. Within a short period of time David was regarded by many as one of the best criminal defense attorneys in the Richmond area. Consequently, David left the firm in 1980, taking one of the partners with him to form Boone and Warren, which today has evolved into Boone Beale. Since 1980, Boone Beale has gained statewide fame in the fields of both DUI and Criminal defense.

Honors and Achievements.

Over the years, David has taken great pride in representing people from all walks of life that have been charged with various types of criminal offenses. In 1982, David was honored by the National Association for the Advancement of Colored People when he was presented with its prestigious Annual Freedom Fund Award, awarded to him as a result of his sensitivity and skill in defending Henrico County citizens.

In recent times, David has been named a Virginia Super Lawyer in Criminal Defense by Law & Politics in 2006, 2007, 2008, 2009, 2010, 2011, 2012 and again in 2013. He was named a Virginia Legal Elite in Criminal Defense by Virginia Business Magazine in 2002, 2006 and 2007. David was also awarded an “AV” Preeminent rating by Martindale-Hubbell Law Directory, the highest possible rating. Richmond’s Style Weekly, in an article spotlighting the best criminal defense attorneys in the Richmond area, has characterized him as a “crocodile in the courtroom.” Additionally, David is often chosen by various attorney groups throughout the state to speak about areas of concern to criminal defense attorneys.

David is a member of the Virginia Bar, the United States District Court for both the Eastern and Western Districts, the Court of Appeals for the Fourth Circuit, and the United States Supreme Court.

In addition to practicing Criminal Defense exclusively since 1980, David has also acted as an Adjunct Professor at both the University of Richmond and J. Sargeant Reynolds Community College, teaching criminal law as well as legal research.
